Transit controls of military goods

According to the Austrian Foreign Trade Act 2011, a transit is the transportation of defence-related products (military goods covered by the Common Military List of the European Union) to and through the customs territory of the European Union to a destination in a non-member state.

This means, a transit licence by the Austrian Export Control Authority / Federal Ministry of Labour and Economy is only required for transportation of defence-related products through Austria originating from outside the European Union with the final destination in a non-EU member state. A licence is not required for the transit of defence-related goods that originate in an EU member state or a non-EU member state and are destined for another EU member state!

If the goods are classified as war material according to the Austrian War Material Act (e.g. full automatic weapons, tanks) the transit through Austria would be a subject of approval regardless from where the delivery starts. In this case the Austrian Federal Ministry of Interior is the responsible licensing authority (Contact details: bmi-III-a-6@bmi.gv.at).
